What is capital gains tax and how does it affect homebuyers in Spain?

Here are the two most common types of capital gains taxes in Spain related to the sale of a property:

1. Municipal Capital Gains Tax (Tax on the Increase in Value of Urban Land - IIVTNU)

🔷 What it is:It’s a municipal tax paid when selling, inheriting, or donating a property. It taxes the increase in the value of the land (only the land, not the building) from the time it was acquired until it is transferred.

🔷 Who pays it:It’s usually paid by the seller (although in donations and inheritances, it is paid by the recipient).

2. Capital Gains Tax in Income (Capital Gain in IRPF or 3% withholding for non-residents)

🔷 What it is:This is the tax paid on the capital gain obtained from selling a property. It is calculated as:Sale price – Adjusted purchase price = Capital Gain

🔷 Tax residents in Spain:They pay it in their personal income tax (IRPF) declaration, according to these brackets:19% up to €6,00021% from €6,001 to €50,00023% from €50,001 to €200,00027% from €200,001 to €300,00028% from €300,001 onwards

🔷 Non-tax residents in Spain:3% of the sale price is withheld directly as an advance payment towards the capital gains tax.

Afterwards, the foreign seller must submit form 210 to:

Pay the difference if more tax is due based on the gain.

Request a refund if the 3% withheld exceeds the actual tax due.
